We are T Associates Pty Ltd and also trade as A1 Appliance Repair. For the purposes of the contract we are the service provider, though work may on occasion be undertaken by others subcontracted by us, you are contracting with us when we provide you service.
Our trading terms are strictly C.O.D. (by credit card, eftpos or cash) on completion of callout for the initial visit, and otherwise payment falls due for the whole amount on completion of the job, as is common practice in our industry. If not paid when falls due, our late fee of $20 may be added to the balance owing.
When a part needs to be specially ordered, the customer may be asked to pay in advance the part price. For large jobs and other work from time-to-time, customer may be asked to sign acceptance of the written quote. We may in our absolute discretion decide that a deposit is payable by the customer before work is to commence.
When we quote or would apply labour fees for the fitting of a replacement part subsequent to the callout, these are based on the part being supplied by us, and we may apply the callout fee again instead of labour fees for the return visit if the customer requests fitting of parts not supplied by us.
Labour fees are currently $25 per 10 minutes or part thereof for part fitting on a second visit, and may apply if the time taken at the callout exceeds 30 minutes, for the duration that the callout exceeds 30 minutes. The customer will be informed of these.
If upon our arrival the customer or a person authorised by them to allow us access to perform the callout, is not in attendance, the customer shall be liable nonetheless for a callout fee. Please contact us asap if you require a change of appointment time or you are running late.
By accepting our commencement of callout or other work, the customer enters a contract to pay the quoted costs. When we supply goods and/or materials as part of the delivery of our service, the customer as bailee agrees that risk in the goods passes to them immediately upon delivery, but title is retained by the us until outstanding balances are paid in full. That is, we hold a lien on goods and materials supplied until we are paid in full. The customer, as bailee for the goods, further agrees that in an outstanding balance to allow us entry to retrieve goods and/or materials supplied in which we hold ownership if the account is overdue. Furthermore the customer is to be liable for our cost at labour fee rates if we need to attend to retrieve goods when the customer is in default, and those costs can be added to the total balance owing.
We will inform the customer early if there is any additional cost anticipated so the customer can decide if they want to proceed with the work. If the customer requests we proceed and we do so, it is deemed that the customer has authorised the work.
When a customer fails to pay within 7 days of being due, accounts in default will be referred to a collection service with our late fee if applied by us, and all collection and legal fees, to be owed by the customer. If the customer is a company, it agrees that a Directors Personal Guarantee applies on any debt to us. When a customer is more than 60 days in default, details of the debt may be provided by us or our agent to a credit reporting agency for listing in the customer's credit file. All invoices are E
